FzioMed strictly enforces compliance with its acceptable use terms under this section. You agree that your visits to the Site are in full compliance with the terms set forth below.

Failure to so comply, in FzioMed's sole discretion, may result in FzioMed immediately preventing you from gaining access to the Site, deleting any and all of your information contained on the FzioMed servers, and/or initiation of legal action against You.
6) INTELLECTUAL PROPERTY
The trademarks, website, corporate names, trade names, domain names, logos, and service marks ("Marks") are the property of FzioMed or other third parties. Nothing contained herein shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Mark displayed on this website without the prior written permission of FzioMed, or such third party that may own such Mark displayed on this website. Third party Marks are the property of their respective owners.
You acknowledge that content, including but not limited to the website design, text, graphics, sound, photographs, icons, video, graphics or other material contained on the Site, or presented to You through the Site, ("Content") are the property of FzioMed and FzioMed does not waive any of its proprietary rights to such information. 8) CHOICE OF LAW
The websites are operated by FzioMed from its offices in San Luis Obispo, California, United States of America. As such, the Agreement shall be governed by and construed in accordance with the internal laws of the State of California, excluding its conflict of law provisions. You and FzioMed agree to submit to the exclusive jurisdiction of the courts of the State of California and further agree that the exclusive venue for any cause of action arising under or relating to this Agreement shall be the Superior Court in and for San Luis Obispo, California. You and FzioMed agree that any cause of action arising out of or related to the Agreement must commence within one (1) year after the cause of action arose; otherwise, such cause of action is permanently barred.
9) INDEMNITY
You agree to fully defend and indemnify and hold harmless FzioMed of and from any and all third party claims, causes of action, demands, costs, damages including both direct and consequential damages, specifically including attorneys fees and costs, expert fees and costs and mediation and/or arbitration fees and costs incurred (whether paid or not) as the result of any incident or claimed incident of any copyright, trademark or other intellectual property right of any third party which is in any way related to Your visit to the Site. Choice of counsel remains exclusively that of FzioMed.
10) MISCELLANEOUS
If any provision of the Agreement is determined by an arbitrator or court of competent jurisdiction to be contrary to applicable law, then such provision shall be construed as nearly as possible to conform to applicable law and the other provisions of this Agreement shall remain in full force and effect.
The Agreement (i) constitutes the entire agreement between You and FzioMed and supersedes all prior agreements between the parties regarding the subject matter contained herein, and (ii) may be modified or amended only in the manner expressly set forth herein.
FzioMed's failure to exercise or enforce any right or provision of the Agreement shall not constitute a waiver of such right or provision unless acknowledged and agreed to by FzioMed in writing.
The section titles in the Agreement are solely used for the convenience of the parties and have no legal or contractual significance.
